Charleston Downtown Limo

This Services Agreement (the “Agreement”), is between Charleston Downtown Limo, a distinguished transportation service provider in South Carolina (hereinafter referred to as “CDL”), and the undersigned Student and their Parent (collectively, the “Passenger”).

WHEREAS, the Passenger desires to secure the premier transportation services of CDL for commuting to and from School, and CDL is committed to offering such services under the terms outlined below.

NOW, THEREFORE, in consideration of the mutual covenants contained herein, it is hereby agreed as follows:

1. Monthly Fee: The monthly fee will be automatically drafted on the first of each month.

2. Term: CDL shall provide services on a ten-month basis throughout the 2023-2024 School Year.

3. Cancellation/Refunds: Cancellation, for reasons other than those under School Cancellation, requires 60 days’ notice by either party. Any payments made prior are non-refundable.

4. Compliance with Rules: Passenger commits to adhering to the rules set forth below, as well as any future amendments by CDL. Rules include, but are not limited to, obedience to the chauffeur, no consumption of food or beverages (except water), and maintaining courteous language.

5. Parent Financial Liability: The undersigned Parent or Guardian accepts full financial responsibility for any damage to the vehicle caused by the Passenger, beyond normal wear and tear.

6. Complaint Process: Any concerns or complaints should be directed to the designated Person of Contact. CDL will work through this contact to address and resolve any issues.

7. Video and Audio Monitoring/Recording: For the safety and security of all, CDL conducts video and audio surveillance inside the vehicle. Passenger consents to such monitoring.

8. Assumption of Risk: Passenger willingly assumes all risks associated with CDL transportation, acknowledging the potential for unexpected events, including the conduct of others and equipment malfunctions.

9. Release of Liability: Passenger, and their legal representatives, absolve CDL, its staff, and affiliates from any liability or claims arising from the transportation service. CDL’s liability for any claims will not exceed the amount paid by the Passenger for the service.

10. Force Majeure: CDL is not liable for service delays or failures resulting from events beyond its reasonable control. In such cases, CDL will endeavor to notify the Passenger and minimize service disruptions.

11. Indemnification: Passenger agrees to protect CDL against any claims or damages arising from their participation in the transportation service, including legal fees.

12. Attorney’s Fees: Should legal action be necessary to enforce this Agreement, the prevailing party is entitled to reasonable legal fees and costs.

13. Agreement Acknowledgment: By signing this electronic agreement, the Passenger enters into a binding contract with CDL for transportation services, under the terms specified herein.

Payment Authorization:

By submitting this form, the Passenger authorizes Charleston Downtown Limo to charge the provided credit/debit card or ACH Bank Account for the agreed-upon amount due for transportation services.
